Floodgate Procedure (West Compound)
Flood Gate Procedure (West compound)
As you know, we have a flood gate in the West Compound that we use regularly to gain access to the slipway. What may not be so obvious is that we (Stour Sailing Club) are legally responsible for its use, and more importantly its closure at all times except when it is being used for access. If we fail to operate the flood gate adequately, the right of access can be removed.
Therefore, we have a clear duty to look after the flood gate and in so doing, our own interests. Please continue to follow the 'standing instruction' and close and secure the gate immediately after your own use unless you talk to another member and agree he or she will secure it after their use.
The Environmental Agency has confirmed our legal obligation and responsibility for managing the West Compound floodgate correctly, and we have designated members that will receive flood alerts by their text message notification system.
During periods of flood, the gate will be closed and locked with a padlock designated for this purpose. This padlock is painted red and tagged "Flood Alert". Only the SSC Committee, flood control designated members and The Environmental Agency will have access to this combination. When flood alerts are predicted overnight this gate will be closed and locked from 2000-0800.Environmental Agency staff are usually in attendance during flood alerts. Members are required to comply with any instructions they issue.
Further information regarding flood gate policy and procedures
Stour Sailing Club has been served notice by the Environment Agency regarding our responsibility as the landowner under The Thames Barrier and Flood Prevention Act 1972 (amended). Failure to manage the flood barrier effectively would mean the club would be liable on summary conviction to a fine and or a custodial sentence.
Whereas at the date of this document, the Environment Agency are still attending during times of Flood Alert, there could be a situation where their staff would be required to attend elsewhere and this is why they have drawn our attention to our legal obligation.
